  The Scottish Ministers, in exercise of the powers conferred by sections 40(1) and 43(3) and (4) of the Smoking, Health and Social Care (Scotland) Act 2005(1), hereby make the following Order:
1- Citation and interpretation
  (1) This Order may be cited as the Smoking, Health and Social Care (Scotland) Act 2005 (Commencement No. 5) Order 2007.
  (2) In this Order–
      “the Act” means the Smoking, Health and Social Care (Scotland) Act 2005.
2- Appointed days
  The day appointed for the coming into force of the provisions of the Act specified in column 1 of the Schedule to this Order, in so far as those provisions are not already in force, is 1st April 2007, but only for the purpose specified in column 3 of that Schedule.

EXPLANATORY NOTE
(This note is not part of the Order)
  This Order appoints 1st April 2007 as the day for the coming into force of the repeal of section 8 of the Health and Medicines Act 1988 (c. 49) specified in schedule 3 to the Smoking, Health and Social Care (Scotland) Act 2005 (asp 13) (“the Act”).
