About this document
This is a standard business lease drawn with additions so that it is relevant to the rural character of the land and buildings let – in this case, any equestrian establishment such as stables, outbuildings, arenas, fields, farm buildings or any combination thereof. If the letting is for a use which is substantially agricultural, rather than purely equestrian, use a farm business tenancy agreement. If you are not sure whether the tenant will or will not carry on a business, use this document.
Who will use this document?
• Any potential landlord (owner of buildings such as stables, sheds or barns);
• Or tenant (someone who wants to use the establishment);
• Who wants to lease or rent any combination of buildings and or land for any equestrian use. The tenant may run a livery yard or a riding school for example. Lease or licence? Any licence is outside of the statutory landlord and tenant framework. But the agreement has to reflect the name. You cannot just call an agreement a “licence” for it to be one. The effect of a licence is that:
• The tenant has no security;
• The landlord has to give no notice.
